Terms Of Use

These Terms of Use (“ToU”) set out the rules of conduct that apply to every person using the Tipino platform — as a Fan, as an Artist, or as a visitor. They complement the Terms of Service (“ToS”); in case of conflict, the ToS prevail for commercial matters and these ToU prevail for conduct matters.

1. Purpose

1.1 These Terms of Use describe how the Tipino platform must be used and what is forbidden. Violations may result in suspension, termination of the account and forfeiture of accrued funds to the Tipino Music Fund, as set out in the Terms of Service.


2. Account

2.1 One account per person. Each natural person may operate only one Fan account. Legal persons may operate one account per entity.

2.2 Age. Fans must be at least 16 years old. Minors below the local legal age of majority need the consent of their legal representatives.

2.3 Accurate data. Display name, contact email must be accurate and kept up to date.

2.4 Account security. Credentials are personal and non-transferable. Fans are responsible for all activity under their account and must immediately inform Tipino of any suspected unauthorised use at getintouch@tipino.app.

2.5 No account sharing. Shared, resold or transferred accounts are prohibited.


3. Linked services

3.1 Publicly supported listening sources at public Beta. A Fan may connect any combination of the following services to have their listening history count towards distribution:

  • Apple Music
  • Last.fm

The following services can be connected for Artist import to be manually allocated by the Fan to his Additional Artists list:

  • Tidal
  • SoundCloud

The fan can also connect other third party services to complete his profile with additional information:

  • Discogs

3.2 Spotify — internal use only. Spotify is currently used by Tipino internally. Spotify is not advertised as a publicly supported listening partner for distribution at public Beta and Tipino may change this scope at any time.

3.3 Third-party terms. The Fan’s use of each connected service remains governed by that service’s own terms. Tipino is not affiliated with, endorsed by or sponsored by Spotify, Apple Music, Tidal, SoundCloud, Discogs or Last.fm. The trademarks belong to their respective owners.

3.4 Scope of authorisation. By connecting a streaming service, the Fan authorises Tipino to read the data required for attribution (listening history, track metadata, playlists the Fan explicitly chooses to import). Tipino does not post, share or publish on the Fan’s behalf without separate consent.

3.5 Disconnection. The Fan may disconnect any streaming service at any time. Disconnection does not retroactively affect months already distributed; it may reduce the Eligible-Artist pool for the current Eligibility Period.


4. Prohibited conduct

The following is strictly prohibited:

4.1 Stream manipulation. No fake streams, bot-driven plays, stream-farming, paid-play services, looping short fragments to reach the minimum songs played threshold, or any other technique intended to artificially influence the distribution attribution.

4.2 Multi-accounting. No operation of, or coordination with, multiple Fan accounts to inflate a given Artist’s payout or to abuse referral, trophy or subscription mechanics.

4.3 Algorithm manipulation. No attempt to reverse-engineer or defeat the distribution logic, including but not limited to the Main-Artist fallback, the split-distribution percentages or the minimum-play threshold.

4.4 Unauthorised access. No scraping, crawling, automated access outside of officially documented APIs, circumvention of rate limits, credential stuffing, or any attempt to access accounts or data belonging to other users.

4.5 Abuse of the service. No denial-of-service attempts, no injection of malicious code, no probing for security vulnerabilities outside a responsible-disclosure programme (if and when published by Tipino).

4.6 Unlawful or deceptive content. No uploading, submitting or displaying content that is illegal, infringing, defamatory, hateful, sexually explicit involving minors, or intentionally misleading. This applies in particular to display names, profile images, biographical text and Additional-Artists entries.

4.7 Commercial misuse. No resale of Tipino accounts, trophies or access, and no commercial use of the service outside the cases expressly allowed by Tipino (e.g. official Artist partnerships).


5. Intellectual property

5.1 Tipino’s IP. The Tipino platform, its name, logos, graphical design, texts and source code are and remain the property of Tipino – Association for Fair Artist Support or of its licensors. No right is granted beyond the limited, revocable, non-exclusive and non-transferable right to use the service as intended.

5.2 User-submitted content. By uploading or submitting content (profile image, biography, Additional Artists list, etc.), the Fan grants Tipino a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and make available that content solely for the purpose of operating and promoting the service. The Fan warrants that they have the right to grant this licence.

5.3 Feedback. Feedback, suggestions or ideas submitted to Tipino may be used by Tipino without restriction and without compensation.


6. Communications

6.1 Transactional emails. Emails concerning registration, billing, subscription lifecycle, policy updates, security and payouts are operational and cannot be opted out of as long as the account is active.

6.2 Marketing emails. Marketing messages are sent only to users who have opted in. Opt-out is available in the account settings and in every marketing email.

6.3 In-app notifications. Tipino may display in-app messages, policy update notices and service announcements. The policy re-acceptance flow is used when the Terms of Service or these Terms of Use are updated materially (Terms of Service §14).


7. Suspension and termination for violation

7.1 Graduated enforcement. Tipino may, depending on the severity of the violation, issue a warning, temporarily suspend the account, refuse further connections of streaming services, exclude the user from specific features, or permanently terminate the account.

7.2 Immediate termination. Immediate termination without prior notice is reserved for serious violations including §4.1, §4.2, §4.4, §4.6.

7.3 Effect on funds. The effect of suspension or termination on accrued and pending funds is governed by the Terms of Service (in particular §6.6, §7.4 and §11.3 Terms of Service). Where distribution is not possible, the Tipino Music Fund rules apply.


8. Reporting abuse and infringement

8.1 Abuse, infringement of intellectual-property rights, fraudulent Artist claims or security concerns can be reported to getintouch@tipino.app. Reports should contain (a) a clear description of the issue, (b) the URL or identifier of the concerned profile / content, and (c) for IP claims, evidence of ownership.

8.2 Tipino reviews reports in good faith and within a reasonable time. Tipino may take intermediate measures (e.g. temporary suspension) while investigating.


9. Changes to these Terms of Use

9.1 Tipino may update these Terms of Use from time to time. The update procedure mirrors Terms of Service §14: non-material changes take effect upon publication; material changes are announced at least thirty (30) days in advance and trigger the re-acceptance flow implemented by Tipino. Refusal of the new version leads to account suspension after the effective date.


10. Language and interpretation

10.1 These ToU are drafted in English. A translation into another language may be offered for convenience; in case of divergence, the English version prevails.

10.2 Section headings are for convenience only and do not affect interpretation.

10.3 If any provision of these ToU is held invalid or unenforceable, the remaining provisions stay in effect; the invalid provision is replaced by a valid provision that most closely reflects the parties’ original intent.
